The collision occurred in the early hours of 26 May 2023, approximately three minutes before the curfew, at a checkpoint on BereSTeiSki Prospekt in Kyiv. Oleksii Tandyr was driving a Lexus ES350 at a speed of 100 km/h and struck 22-year-old National Guard soldier Vadym Bondarenko, who was on duty at the checkpoint. Bondarenko was thrown approximately 30 metres, fatally injured, and died at the scene.

The court found Tandyr guilty under Part 3 of Article 286-1 of Ukraine's Criminal Code of violating road-safety rules while intoxicated, causing the soldier's death. Examinations confirmed his intoxication, a significant speeding violation and violations of road signs, including braking only immediately before impact.

Tandyr refused to undergo an intoxication test after the collision and attempted to substitute water and saliva during the compulsory collection of biological samples. The State Bureau of Investigation conducted 18 examinations, including forensic medical, chemical and automotive technical examinations.

Kyiv's Sviatoshynskyi District Court sentenced Tandyr to nine years in prison, credited three years and five months spent in a pre-trial detention facility, barred him from holding judicial office for 10 years, and ordered him to pay the victim's family 40 million hryvnias in compensation. He remains in custody. He was dismissed as a judge of the Makariv District Court by the Supreme Council of Justice in August 2024.

Sådan beskriver ukrainske kilder det

Ukrainian reports focus on Tandyr's former status as a judge, the fatal collision at a National Guard checkpoint and the nine-year sentence. The coverage also details his refusal to be tested for intoxication, the late braking established by experts, the lengthy court proceedings, custody, asset measures and compensation for the victim's family.

Hvor dækningen adskiller sig

The sources disagree about the age of the soldier who was killed. Most identify Vadym Bondarenko as 22 years old, while one report says he was 23.

Baggrund

The ДБР opened a criminal investigation after the collision and completed its pre-trial investigation in August 2023. The case then went to court, where defence requests led to more than 50 hearings and over 30 motions to recuse the judge and prosecutor. Tandyr attempted to leave pre-trial detention through mobilisation, but the court rejected the request. In May 2026, the ДБР also informed him of a suspicion that he was involved in a scheme to take over flats belonging to deceased people.
